Health Judicialization and executive power
The judicialization of health and the Executive Branch is the subject of a book released in June by the livre-docente professor of USP's Law School, Maria Paula Dallari Bucci (with Clarice Seixas Duarte) entitled "Judicialization of Health: The Vision of Executive Power "(Saraiva Publ.).
The judicialization of health has taken on epidemic proportions, in the evaluation of the Judiciary itself, which has sought measures to address the problem, such as the 2009 Public Hearing in the Brazilian Supreme Court (STF), the creation of the Health Forum in the CNJ, and recent votes in the STF, conditioning the granting of high-cost or unregistered drugs to Anvisa to stricter requirements. However, the sufficiency of these measures is questionable, given the neglect of the main focus of the problem, the Executive's lack of strategic vision to attack the factors that play in an undifferentiated mass both the so-called "difficult cases" and the thousands of ordinary demands, which arrive there because of a lack of a satisfactory route that provides for the fulfillment of ordinary requests. The work seeks to explore, based on the institutional analysis, these arenas of action and how the legal element presents itself conforming the processes and interactions that generate this result. It is an applied study of legal strategies of public policies.
